This website is operated by Calibre24.com.au. Throughout the site, the terms “we”, “us” and “our” refer to Calibre24.com.au. Calibre24.com.au offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes or prior to website use. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

SECTION 1 – PRICES & PAYMENTS

Prices:

  • Prices are listed in Australian dollars (AUD) and include GST for Australian customers.
  • Prices don’t include any taxes or duties that may be required for any country when the watch is shipped/exported out of Australia. The customer is responsible for paying all such taxes and duties required by their country, as applicable by their laws. These duties and taxes will be added on top of our Price + Shipping fee.
  • For current exchange rates, please use xe.com
  • Australian purchases / deliveries will include Goods & Services Tax (GST). There’s no tax or duty included in overseas deliveries (outside of Australia).

  • Crypto Currency.

Bank Transfer:

Please use your Invoice Number as the payment reference. Your order will not be shipped or ready for collection until the funds have been received in our account in full.

Company May Decline Orders:

Please note the Company (Calibre24) reserves the right to accept in whole or part of any order or decline an order.

We will issue you an invoice once an order is confirmed but the item/watch will not be reserved for you until we have received the payment or at least a partial deposit that we may have agreed with you for reserving the item/watch.

Card Payments:

We accept all major cards for payment including VISA, Mastercard and Amex. Our invoice or website order comes with a secure payment link that you can use to make payment. The full amount, when invoiced manually, can also be split between multiple payments using our secure payment link. The credit card payment comes with a processing fee that cannot be negotiated or avoided.

Card Processing Fee:

The card processing fee is charged back to you/customer and is added at the time of payment, on top of our price. This fee is shown on your screen prior to the payment (additional 1.4% fee will be charged on top of this, if you’re paying using and international credit card, not issued by an Australian Institute), and there is no hidden fee outside of what you see on the screen, prior to the payment. Please note that if you’re order from overseas and outside of Australia or if you’re using an international card (not issued by an Australian Institute), an additional card fee of 1.4% will apply to you on the total value of the order, minus the card fee that you may have already paid against your purchase.

When you choose to use credit card payment method, you agree that the credit card processing fee is not refundable under any circumstances. The card processing fee can be avoided by making bank transfer payment for your purchase, which comes with the assurance that you will receive a full price refund if you’re not happy with the product that we delivered to you and your return was authorized by us, consistent with our Returns Policy.

Please note that when you pay us using your card (Master, VISA, Amex and all other cards included), there will be a “Security Hold” on shipping of your item for up to 10 business days, before we will ship the item. You can avoid this hold by doing a bank transfer to facilitate a quicker, the same day, or the next day dispatch from when the funds clear into our account.  We may be able to reduce the security hold but this can only be confirmed after the payment has been made and will not be less than the next day dispatch under any circumstances.

Know Your Customer (KYC) Additional Documentation for Card Payments

When you choose to pay us using your card (Master, VISA, Amex and all other cards included), we may ask you for additional security verification details, which may include, but are not limited to:

  • Scan of your primary Photo ID card and/or Photo ID of the credit card holder.
  • Scan of your secondary Photo ID card and/or Photo ID of the credit card holder.
  • A supplementary Identification document like a utility bill, Medicare card etc.
  • Any other form of identification document.
  • A video call with you where you show us your photo ID and the physical card with complete details (except the CVC).
  • An authorization letter from the card holder, confirming the transaction.

These details are usually only required when the transaction made by your card has been flagged in our system as higher risk than usual. We use advanced Fraud Radar tools to identify and risk rate card transactions. The factors affecting the risk rating may include, but aren’t limited to:

  • Payer’s name different than the name on the card.
  • Billing address different from the shipping address.
  • History of card rejections, authorisations etc. in percentage.
  • Previous failed attempts/transactions.
  • Other parameters that may make the transaction suspicious.

Shall you fail to provide these details to us, that we may request from you, we will cancel your order and refund your payment. You understand and agree that the card processing fee, charged by the platform in all such cases is non-refundable and will be deducted from your refund amount.

Existing Customers

If you’re an existing customer with a previous purchase history from us for at least six months or longer, and given that your details (name, shipping, card details, email etc.) haven’t changed from your last order, you will be exempt from the “Security Hold” and we will endeavor to ship your item/watch to you the same day, the order is placed.

SECTION 2 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 3 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 4 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue or remove any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Calibre24.com.au, our directors, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Calibre24.com.au and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 17 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 18 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 21 – RETURNS POLICY

Buy with peace of mind, and confidence when purchasing from us. You may return new, unopened, unworn, unaltered items for a full refund within 03 days after delivery to you (excluding shipping and handling charges), minus a restocking fee of 20%.

If you received the item that is not in the condition as advertised or consistent with how we described it, or if it was damaged in transit, you can report an issue within 01 day of delivery date and return it to us, and receive a full price refund (please note that if you are paying by card, the card processing fee is not refundable).

Returns are subject to a Calibre24 Returns Authorization; shipments returned without authorisation will not be accepted. Please return items within 03 days of when we delivered it to you, in the same condition, unworn and with the same accessories as purchased, with online purchases. If the condition of the item changes from how we sold it to you, we cannot accept the return, irrespective of it being returned to us within the above stated timelines. If you report issues after 03 days from the date when we delivered the item to you, we cannot accept returns, unless you negotiated this timeframe with us and we agreed to this, prior to the delivery.

Returns are not accepted for a change of mind or incorrect decision. We may issue you a store credit for such returns after a deduction of a 20% restocking fee.

International Orders
Items sent to an address outside of Australia are final and cannot be returned.

SECTION 22 – SHIPPING POLICY

SHIPPING/DISPATCH TIMES:

When you make payment via Bank Transfer, we endeavour to ship the products at the same day or next business day when we receive your payment into our bank account. However, in some circumstances it can take up to 4-7 Days to ship an item, using the following carriers: Fedex/TNT, DHL, Auspost, Brinks or Ferrari.

When you make payment via Credit or Debit Card, we apply a “Security Hold” for 2 full business days from the date of the payment, before we will ship the item to you. Once the security hold is completed, we endeavour to ship the products the next day. However, in some circumstances it can take up to 4-7 Days to ship an item, using the following carriers: Fedex/TNT, DHL, Auspost, Brinks or Ferrari.

Please note that the above timelines will be extended in the event we are closed for public holidays or for other announced temporary closures. When we are closed, this will be announced on the top banner of the website or if you speak with us prior to the purchase, we will inform you the exact shipping dates.

The shipping courier selected is dependent on the value of the item/watch sold/being shipped, your location, transit time, payment method, courier availability, cost etc.

For security and insured shipping, we may ask you to provide us with a copy of your photo ID that may further be verified by the delivery driver before delivering. Shall you fail to produce the photo ID before the booking or at the time of delivery, the item will not be shipped/delivered and we may refund in all such circumstances. The amount refunded will be the total amount you paid minus the card processing fee and any shipping cost, that may have applied.

DELIVERY TIMES:

 

In most circumstances, we have delivered shipments the next day after we ship, but if you are in a remote location or in ACT, it can add from one extra day to a few extra days. It is not uncommon to have flight delays, or other delays beyond our control where a next day shipment can be delayed by one business day to a few business days, although it is not very often that we see such delays.

INSURED SHIPPING (if applicable).

We ship fully insured via overnight express shipping. The overnight express shipping doesn’t guarantee that the item will be delivered the next day, but it intends to deliver the next day, and in most cases, we have delivered watches the next day from the dispatch.

Please note that while the watch/item delivered to you comes fully insured, there’s a set of requirements you must fulfill, follow and meet to be able to claim insurance. In the event, you can’t provide the evidence as follows, or haven’t followed the precautions, the refund and insurance may become null and void.

When we deliver an item to you:

–              The box will be sealed with the shipping label on both sides, or inside a sealed bad with a unique seal number. You agree that you will verify that neither the seal is damaged nor there’s any signs of the original label bring ripped or torn apart before you receive the item.

–              You agree to visually check all the sides of the box and report any issues or signs of potential third party intervention during transit, prior to unboxing.

–              You agree that you will video record receiving and unboxing of any item that we have delivered to you to be able to produce evidence in the event when there is an insurance claim for a missing, stolen or damaged product in transit.

–              You agree that if you are not able to produce a video evidence of you receiving our shipping (sealed) box with a damaged seal, damaged label, damage content, missing item, empty shipping box etc. then the insurance will become null and void.

–              You agree to visually check all the sides of the box and report any issues or signs of potential third party intervention during transit, prior to unboxing.

–              You agree to unbox and inspect the watch as soon as you have received the item from the courier. Failing to inspect and verify within 3 hours of delivery may jeopardize the insurance.

–              You agree and understand that you once the item is delivered to your address, the insurance cover is over and that any damage, stealing or activity that takes place at your address or by the person receiving it is not covered under our insurance and that you will remain responsible for all such loses and damages.

–              You agree to check and inspect the item/watch that we delivered to you the same day and as soon as possible, both for its condition to be consistent with how we described it, and for its function (timekeeping, hands movement, date change etc.). In the event there’s any observations or issues, you agree to report to us the same day to facilitate a return or insurance.

–              You agree that you will verify the shipping box to match with the photos that we may have sent to you at the time of shipping, and report any issues to us prior to opening the box.

In the event when you received the shipping box differently from how it looked in the photos that we may have sent to you at the time of shipping, and you fail to report it to us prior to unboxing, you agree that the insurance claim will become null and void.
